开设DC聚众Dubo 落入法网分别获刑

为谋取暴利，云南镇雄两被告人租用他人房屋开设DC聚众Dubo，因而受审获刑。近日，云南省镇雄县人民法院对这起Dubo犯罪案件公开宣判，两被告人因犯开设DC罪，分别被判处有期徒刑一年，缓刑二年，并处罚金人民币20000元。 被告人王必成，男，出生于1978年2月7日，云南省镇雄县坡头镇仁和村人。 被告人张安均，男，出生于1965年6月19日，云南省镇雄县坡头镇坡头村人。 2010年农历10月的一天，被告人张安均伙同王必成在镇雄县坡头镇仁和街上以每月人民币3000元租韩必英门面开设DC。Dubo方式采用麻将牌的三十六颗筒子做Dubo工具，一人当庄，三人守门，当庄的与守门的进行Dubo，赌完一条牌后，被告人王必成等人以桌面上的钱的多少进行抽头。在开设DC过程中，被镇雄县公安局坡头派出所的民警康玉平警告二被告人等不能再组织Dubo。一星期后，张安均与王必成共谋后继续在仁和街上开设DC，并联系贵州省毕节市的樊方方（另处）入伙，DC抽得的利润，除去开支后二被告人与樊方方均分。二被告人与樊方方分别联系仁和、坡头、毕节的人员参赌，其间，王必成得利人民币8500元，张安均得利人民币4000余元。同年11月25日晚，该DC被公安机关查获，当场收缴赌资人民币80000余元。 公诉机关认为，被告人王必成、张安均的行为已构成Dubo罪，建议判处三年以下有期徒刑。 , t) i1 g7 _: T
法院经审理认为，被告人王必成、张安均以营利为目的，开设DC，聚众Dubo，对其行为应以开设DC罪定罪处罚。公诉机关指控的事实清楚，但指控的罪名不当。庭审中被告人王必成、张安均的认罪态度较好，可酌情对其从轻处罚。鉴于二被告人认罪态度较好，没有再犯罪的危险，可对其宣告缓刑。遂依照《中天策民共和国刑法》等相关规定，作出了前述判决。 |
