导游辞职专心参与网络赌球 每月盈利数千元被判

本报讯(记者 王巍)在海南通过北京的服务器登录Dubo网站，每月收入3000—5000元，以网络赌球为业的赵某因Dubo罪于今天上午被东城法院判处有期徒刑6个月。
" R; w/ w: A: I( o- e# P 公诉机关指控，在2009年到2010年7月间，赵某在海南省海口市，通过租用设置在北京东城区歌华大厦等处机房内的服务器登录境外赌球网站，长期进行网络赌球活动，并以此为主要生活来源。
$ Y' @4 w) A5 i5 E$ v 32岁的赵某对公诉机关的指控完全认可。
3 _5 C. u* w0 t4 T; W 赵某称，之前他在网上看到别人赌球，于是在网络上联系到一名叫“燃烧”的网友，以每台1000元的价格租用了两台服务器，然后通过该服务器登录境外Dubo网站。% Q! e! ^1 I4 y
赵某原本是一名导游，后来把工作辞了，专门以赌球为生。# c2 r! ~/ W' _
“我赌球赢多输少！”今天受审的赵某语气中流露出些许得意。- e2 R: \# i4 }% D
据了解，一开始参与赌球时，赵某输的次数居多。后来通过网络搜索，赵某联系到一个专门提供赌球软件分析的网友，赵某用该软件分析立刻“翻本”。
: I5 w+ C$ ?% N$ c) x# H 除去每月1200元的软件分析费用，赵某月收入在3000—5000元。在海口租房子与女友同居的赵某，将赌球当成了稳定的生活收入来源。' o/ j) {( ^$ z$ Q# k# n' V0 O
赵某每天赌球就好像上班一样，遵循着昼伏夜出的规律：晚上十点上网开始参赌下注，直到早上4点结束，然后一觉睡到下午，起床后优哉游哉地外出喝茶，再等待晚上开工。
# W8 q m6 s: s- K! `+ Y 据了解，赵某是赌球网络中最低一级的参与者，并没有作为庄家发展下线。
Z7 q3 }* O. ~- z' }3 a4 R 法院审理后认为，赵某以Dubo为业，以盈利为目的参与网络赌球，其行为已经构成Dubo罪，因此判处其有期徒刑6个月。4 d4 W+ i7 w$ N) C$ ~* C9 A2 j
为何身在海南租北京服务器？
# |4 s+ W, B; S! l- { w 身在海南的赵某为何要不远万里联系北京的服务器赌球呢？赵某说，一是由于北京是大城市，服务器相对稳定；二是可以躲避公安部门对参赌电脑的筛查，风险比较小。
/ _- Z h3 R; j3 a) K 而赵某在北京的服务器被公安部门查封后，他还曾利用在香港的服务器继续参赌。
; v. O) @. W0 S; a" O9 g# w 被告人为何获得“轻判”？6 w7 k4 j9 q( l) d# Z" g# @* K7 u; k
宣判后，法官表示Dubo罪不同于开设DC等罪名，是一项最高刑期为3年的轻罪。# D- k, g- y7 ~8 a
赵某的行为虽然没有给别人造成妨害，但已经破坏了社会管理秩序。
" z/ ?5 ~# M! f 结合赵某较好的认罪态度，以及他的行为的社会危害性等综合因素的考虑，法院判处他有期徒刑6个月。 |
