商家竟然用彩票找零 律师称涉嫌变向买卖彩票

据报道此事的《绥化晚报》记者杨成申介绍，这个饭馆只是一个小吃部，老板是在帮亲戚代销彩票，并没有强迫顾客接受彩票找零，店主还开玩笑地说：“说不定哪张彩票就能让顾客中上大奖呢。”在当地，这样做的商家不止一个，消费者也都比较认同，认为是小钱无所谓。
) a( f5 X( ~# V' h' C 当地消协回应，只要店主没有强迫顾客必须接受彩票找零，且由顾客自愿选择，就属合情合理。那么行业内看法又是怎样？《公益时报》记者随即进行了采访。业内人士程阳对此指出，这种情况关键的核心词是“自愿”。“自愿”是基本前提，但即便自愿了也要看合法与否。
9 m; u Y$ \% {5 b$ G0 M. r- d- U" O 绥化市福彩中心工作人员表示，现在该省机构允许个人批发代销，以社会网点的形式卖刮刮乐。这个小吃部就应属于个人直接代销的社会网点，用彩票找零是在双方自愿基础上进行的，因此这种销售应当是合法的，不会对公益形象带来负面影响。上述工作人员称，从即开型彩票印刷技术含量看，目前还没有能对整张彩票进行造假的可能。且找零用的刮刮乐都是小面值的，这对造假者来说也没有什么盈利，所以消费者不用过多担心会有假票滥竽充数。现在当地已有80%彩站配有即开票扫描枪，消费者可随时拿彩票去扫描查验。1 w5 F, W( ~$ D% _0 [0 J3 ~; p

此种行为到底合不合法，记者采访到了上海市汇盛律师事务所邓律师。邓律师告诉记者，我国的法定货币只有人民币，其他任何物品都不可代替，既使是黄金白银也不行。用彩票来找零存在涉嫌变向买卖彩票的嫌疑。如果这种行为只是偶尔发生，并在双方自愿的前提下，法律上还是可以允许的。但是如果长期进行这种行为就是把彩票当成了货币来进行支付，属于违法行为。 |
