据了解，今年32岁的李国家住即墨，是城阳某公司的一名老业务员，平时主要负责替公司回收货款。虽然有固定的工作和收入，但他仍不满于现状，老想着尽快发财。他负责回收货款，经常一次回收数十、数百万货款，这些钱经由他手交到公司，哪笔款先到哪笔款未到只有自己知道。考虑到工作的便利，他想出一个主意：截留部分货款用来购买彩票，公司业务员众多，偶尔一次小账目，公司一时半会也不会过问，即使领导问及，也先以没有收齐为由进行拖延，然后找机会偿还。 j* e! ~, Z5 k, F
一笔小账牵出28万“漏洞”
/ I1 l, w& g( X. Z 临近2008年年底时，公司部门负责人因一笔小账目找到一家业务客户交流，明明是已经交齐的货款怎么还来催债？客户的反问引起公司的怀疑。经过调查，公司得知这笔货款是李国回收的，就立即找他了解情况。李国没办法，只好承认了挪用货款的事情，并先行向公司返还了3万元。期间，公司还了解到，经由李国回收的还有许多账目存在问题。见事情败露，李国只好到公安机关投案自首。经警方调查，2005年7月份至2008年3月份，近3年时间，李国先后将从多家客户回收的28万余元货款截留，用于购买彩票。0 o2 b# N H9 {! O$ v
想耍小聪明被判三缓三0 e( t/ ^7 ~1 W9 b0 ^# Q
据李国交代，回收货款以后，为了不让公司发现，他将一小部分货款截留，再有货款回收后，再截留一小部分，时间比较长的账目，就用刚回收的货款折抵。因公司业务员众多，部分小账目公司一时不会过问，导致李国的胆子越来越大，截留货款积累的数额也越来越大。案发后，李国亲属将所有货款退赔给公司。法院审理认为，李国身为公司工作人员，利用职务上的便利，挪用单位资金进行营利活动，数额巨大，构成挪用资金罪。 |
