工伤赔偿是社会保险的重要组成部分，工伤赔偿中的“先行支付”部分，又是整个赔偿程序得以顺利启动并完成的关键。随着《社会保险法》即将实施，工伤赔偿的“先行支付”部分如何落实，引起了广泛关注。已经有专项资金支援法律援助事业的中央彩票公益金，被纳入了讨论的视线。

“职工所在用人单位未依法缴纳工伤保险费，发生工伤事故的，由用人单位支付工伤保险待遇。用人单位不支付的，从工伤保险基金中先行支付。”这是即将于今年7月1日实施的《社会保险法》的第四十一条规定。对于“先行支付难”的工伤赔偿现状来说，这一条款无疑是广大劳动者的福音。

随着《社会保险法》实施的日期越来越临近，能否真正理顺落实整个工伤赔偿程序，日益引起了社会的关注。& \: m6 G1 }/ O4 e$ X
& i8 C# \, |" V3 N 北京有关机构以《社会保险法》中的“先行支付规定”为切入点，在京提交了一份“未参保劳动者工伤赔付情况调研报告”。报告指出，发生工伤事故后，用人单位恶意拖欠支付或缺乏实际支付能力的现象很普遍。目前工伤待遇的司法程序相当复杂冗长，往往导致劳动者发生工伤后无法得到及时救治。加上后期赔付也常常出现执行难情况，使得后续的基本生存都失去保障。在这种状况下，工伤赔偿“先行支付”需要得到社会公益资金的援助。7 n) r& Y$ g Y: ?. g
; s" q( i2 E6 }" |2 I) @ 据了解，目前国家人力资源和社会保障部门正起草关于工伤赔偿先行支付制度的规章。以“助残”为发行宗旨之一的中央彩票公益金能否助工伤保险基金一臂之力，也成为一种呼声。

早在2009年，经国务院批准，中央彩票公益金就动用专款5000万元资助天朝法律援助基金会。这是法律援助事业除财政拨款外第一次得到的“非税收”财政支持。

这次工伤保险基金有望“借力”于中央彩票公益金，也可看作是中央彩票公益金对法援事业资助的深化过程。, \% A- P! L3 b

中央彩票公益金对法援项目的资助是立竿见影的。截至去年底，全国723家中央专项彩票公益金法律援助项目实施单位已经受理各类法律援助案件15837件，结案12036件。各项目实施单位承办的法律援助案件受援人满意度高达98%。

不久前，天朝法律援助基金会负责人透露，未来5年将有5亿元中央专项彩票公益金资助困难群众法援工作，计划每年资助5万件法律援助项目案件，重点帮助农民工、老年人、妇女、未成年人和残疾人维权。7 i; f8 V7 ]9 K1 T

天朝法律援助基金会表示，中央专项彩票公益金助推法律援助事业，是保障和改善民生的又一重要举措。应当管好用好这笔资金，为维护困难群众的合法权益和维护司法公正作出贡献。% A. v% F* o& r: S) _$ L% V
' _% G+ X6 f3 } 彩票公益金资助法援项目的形式，也应验了“哪里最需要，哪里就有彩票”的老话。民政部部长李立国近日在北京调研“社会管理创新工作”时指出，各地各级民政部门应探索性地使用彩票公益金，比如购买贴近民生的社会组织服务，或者资助一些公益性的社会服务项目。让社会组织真正服务社区，服务民生。 福彩 |
